The Midbara website (at www.midbara.co.il) is an online site that provides, among other things, information about the Midbara Hotel (hereinafter: "Midbara"), the services provided by Midbara, prices, promotions, and more. Additionally, through the website you can purchase stays and vacation packages, all as detailed on the website (hereinafter: “www.midbara.co.il”).

 

Please read this Privacy Notice before using the site and before providing personal data (such as name, phone number, email, payment details, etc.) to the company through the site.

 

In this notice, the terms “we,” “our,” “us,” and “the company” refer to Tamarg Initiatives Ltd., Company No. 513102665 (hereinafter: “the Company”).

 

This notice details some of the processes implemented in collecting information from and in connection with the site and the uses made of this information. If you do not wish to provide information or do not agree to these terms, you are not legally obligated to do so, but you may not be able to receive certain services or purchase certain products from us. Some information is required by law.

 

The detailed terms of the privacy policy below constitute an inseparable part of the website’s Terms of Use.

What personal information do we collect?

As stated in the Terms of Use, in the context of an order and/or request for a price quote and/or updating your details, you will be required to provide personal information and additional data required due to the nature of the requested service. We also collect information available to us by law, such as: information from government databases, credit data service companies, and any other database established by law. The information collected is related to the provision of Midbara’s services.

 

This information may include, depending on the service provided or your relationship with Midbara and subject to any law, among other things: identifying information and contact details; passwords; place of employment; marital status; information included in answers you provide for identification and security questions; location information; and so forth.

 

Midbara will keep the information collected about you in its databases as detailed below.

 

Information we collect

We collect two types of data about site users:

 

Active information – such as name, identity number, email address, telephone numbers, payment details, requested accommodation dates, etc., which the user provides on the site, inter alia, for the purpose of booking stays and vacation packages.

 

Passive information – such as the type of browser used by the visitor, the visitor’s IP address, and more.

 

Site visitors are aware that all details, data, information, and documents you have provided or will provide to the company or anyone on its behalf, including personal details, may be entered into a database registered in the name of the company, subject to the Privacy Protection Law, 1981 (hereinafter referred to as the “Database” and “Privacy Protection Law”). By providing details to the company via the site, the visitor declares that all such details were provided voluntarily and with full consent, without any legal obligation to do so.

 

Personal details you provide actively during browsing on the site will be used only for the purposes expressly stated at the specific location where they are provided, and in particular, no use will be made of the payment details you provided except for processing the payment for the purchase you requested via the site.

 

Visitors to the website are aware that the Company and/or anyone on its behalf may contact them in the future via direct marketing based on the information contained in the database, including matters not related to this policy, and may contact them with marketing and/or promotional proposals of any kind through various communication means, all subject to the Privacy Protection Law and applicable law (hereinafter: “Contacts”).

 

Visitors are further aware that information they provided as stated above may also be entered into additional databases held by the Company (if any), used for its direct marketing services and those of anyone on its behalf—and that the data may be used by the Company and/or its representatives, subject to legal limitations and the Privacy Protection Law.

Notwithstanding the above, it should also be noted that:

 

(a) Information collected about visitors may be transferred outside Israel, subject to applicable law (including the Privacy Protection Law and related regulations).

 

(b) We may be required to transfer information about site visitors (in whole or in part) to state authorities or third parties as required by law.

 

(c) If the Company is acquired (in whole or in part) or transfers its business (in whole or in part) to any third party, it is possible that information about site visitors will also be transferred to that party.

The server hosting the website may be located outside Israel. In any case, we will collect, process, and use information about visitors solely in accordance with this Privacy Notice.

 

Deletion, correction, and inspection of data

3.1 According to the Privacy Protection Law, every person is entitled to inspect the information collected about them and held in the Database. A person who reviewed their information and found it to be incorrect, incomplete, unclear, or outdated may contact the database owner to request correction or deletion of the information.

 

Visitors to the website are entitled, upon request, to inspect the information collected about them and held in the Database, and/or to request deletion from any of the Company’s or its representatives’ databases, or to instruct that information referring to them not be provided to any person or type of persons, for a limited or permanent period—all via a written notice to the Company, specifying the request to inspect and/or delete the information. It is also clarified that visitors who do not wish to receive Contacts (as defined in Section 4.1 above) may request removal of their name from the mailing list via the appropriate checkbox in emailed messages (if sent), via registered mail, or via email to the Company.

 

Changes or deletion of details provided actively by visitors to the site, as well as inspection (in accordance with the law) of information about a visitor held by the Company, as stated in section 3.2 above, can be done in various ways, including by completing and submitting the required details on the site’s “Contact Us” page or by email to midbara12@gmail.com.

Applicable Law

This privacy notice is governed by Israeli law and interpreted accordingly. Exclusive jurisdiction regarding disputes arising in connection with this notice is granted to the competent courts sitting in Tel Aviv‑Jaffa.

Midbara will retain and secure the information provided and/or collected about users of the site. Midbara may use the collected data, among other things, for the following purposes:

 

Managing and operating any service requested by users, and for communicating, updating, confirming, and/or notifying them of any matter related to the service requested.

The user confirms that submitting the data to Midbara is done voluntarily and at their own responsibility and consent, and they have no claims or demands against Midbara regarding this issue.

 

The user declares and undertakes that all information provided or updated on the site is correct, true, and accurate, and was provided personally and not on behalf of third parties, unless explicitly permitted to do so, and in any case the responsibility for providing that information remains with the user.

Midbara may collect and use information you provide on the site and/or information accumulated about you, including during usage of the site, in order to improve, enrich and/or modify the site, services, and content offered, as well as to update you and conduct satisfaction surveys about the services offered by Midbara and/or its representatives and/or by third parties with whom Midbara has business cooperation.

To Whom Information Is Transferred

Midbara will take reasonable and customary measures to protect and prevent the transfer of personal identifying details such as name and address to third parties, except as follows:

 

If the user explicitly requests or consents to it or for providing service through or from the site.

 

For transferring to suppliers of products and/or services to complete a requested operation by the user on the site or linked sites.

When Midbara believes that transfer is required to prevent severe damage to the property or body of Midbara, the user, or third parties, or to prevent severe other harm at Midbara’s full discretion.

 

In cases where Midbara transfers or outsources its activity, rights, and/or obligations toward the user to a third party, provided that the third parties accept the terms of this privacy policy.

 

Contact Methods, Advertising and Direct Mailing

When you provide us with your contact information, you agree that we will use it to contact you and send you marketing messages and advertisements on various matters. Contact methods may include mail, email, telephone (including recorded messages and SMS), fax, social networks, and other means.

 

You have the right to request removal from the direct mailing list (as defined by the Privacy Protection Law), through any communication channel, and to prevent the sending of advertisements (as defined in Section 30A of the Communications Law) via email, SMS, fax, or recorded phone message. If you have already notified us that you do not wish to be contacted and do not receive advertisements, no further notification is required.

 

Please note: even after requesting removal from receiving mailings or advertisements, you will still receive communications we are permitted or required by law to send (such as service-related messages), even without your consent.

Midbara does everything in its power using standard and advanced technological security measures to protect the data provided by site users and customers. Users are aware that although Midbara dedicates resources and takes strict measures to prevent unauthorized site access and potential privacy breaches, it cannot guarantee the site will be completely interference-free.

 

Midbara uses encryption and security means standard in the Israeli e-commerce sector for online data transmission, as required by law. These safeguards ensure encrypted data flow between the user's computer and the site servers.
